Terms and Conditions (T&C)

1. Scope of Application
These T&C govern the relationship between Zwischengas AG (hereinafter Zwischengas AG) and users (hereinafter users) of the online services and products offered by Zwischengas AG on the internet. By using the respective services, the user accepts these T&C, which also form part of every contract for the use of the offered services that require registration and/or payment. Any deviating terms of the user shall not apply. Deviations require the express consent of Zwischengas AG. "zwischengas.com" is used below as a synonym for all online services operated by Zwischengas AG.
These T&C apply to:
a) all users of zwischengas.com who use the publicly accessible services of Zwischengas AG that do not require registration and/or payment;
b) registered users of zwischengas.com who use the free online services of Zwischengas AG;
c) registered users of zwischengas.com who use paid services of Zwischengas AG, regardless of whether they themselves or a third party paid for the subscription or service.
To access the services that require registration, either free or paid, the user must register online and will receive a personal zwischengas.com user account (hereinafter user account). Access is activated after entering the required registration data. The zwischengas.com account is reserved exclusively for natural persons. Automated account creation is not permitted. Creating accounts under pseudonyms, fictitious names, or in combination with anonymous email accounts is prohibited. The content on zwischengas.com is intended for interactive use by individuals. Automated retrieval or redistribution of data is only permitted with the consent of Zwischengas AG and may be revoked at any time.
Zwischengas users automatically receive newsletters and product updates via email. The receipt of individual newsletter types can be disabled. If a user purchases a Zwischengas product, newsletter delivery will be reactivated, even if it was previously deactivated.
2. Services Provided by Zwischengas AG
The services provided to the user may be free or paid, depending on the specific service. The content and scope are defined by the contract between the user and Zwischengas AG as well as these T&C, which form the contractual basis. Zwischengas AG reserves the right to modify or improve its services, including scope and detail. Upon registration, the user receives credentials (username and password) for their personal user account. Creating a zwischengas.com account is free. This unlocks access to all registered, but free, offers—such as the “recommend article” function.
3. User Obligations
Services used by the user are billed according to the current rates. Prices are published online and charged in euros within the EU, and in Swiss francs in Switzerland and other countries. Payments are typically made via credit card. If invoices are used, payment is due within 10 days. In case of late payment, access may be blocked. Users must keep their credentials confidential. Zwischengas AG is not liable for damages resulting from misuse or loss of credentials.
Users must maintain a valid email address in their account to receive important updates (e.g. T&C changes).
4. Availability
Online services are usually available 24/7. Zwischengas AG may limit or suspend service for technical reasons.
5. User Equipment / Installation and Costs
The user is responsible for ensuring their hardware and software are compatible. Zwischengas AG can provide system requirements upon request. It is not liable for damages due to incompatibility. The user bears all connection and setup costs.
6. Liability of Zwischengas AG
Zwischengas AG is liable only for intentional or grossly negligent breaches. Liability is limited to the amount billed for the service. No liability is accepted for indirect damages or profit loss. Damage from viruses, spyware, etc. is excluded. Employees and representatives are likewise excluded. Zwischengas AG is not liable for service interruptions caused by maintenance or upgrades.
Removed content due to legal or contractual reasons does not entitle the user to a refund. Content is created with care, but Zwischengas AG makes no guarantees and accepts no liability for accuracy or completeness. Any contractual claims must be submitted within 10 days via registered letter.
Zwischengas is not responsible for third-party content (e.g. ads, external valuations) and provides no guarantees for their accuracy.
Users agree to receive emails (confirmations, newsletters, alerts, etc.) unless they explicitly opt out.
7. User Liability
The user is liable for damages resulting from misuse of their credentials.

9. RSS News Feed
RSS feeds are allowed only for desktop applications. Use in mobile apps is prohibited. Feeds must link directly to zwischengas.com with no intermediary pages or additional content. Source must be credited. Content must not be archived. Zwischengas may revoke access at any time. Free use is only allowed for private, non-commercial purposes.
10. Copyright
Users are granted a non-transferable, non-exclusive right to use content personally during the contract term. Intellectual property rights remain with Zwischengas AG or the original rights holders.
Premium PRO users may download high-res photos and facsimiles for personal research. Mass downloading or duplication is not allowed. Use of download tools (e.g. Webripper, Sitesucker) is prohibited. Download limits apply. Violations may lead to account termination.
Occasional personal downloads of single JPGs or PDFs are allowed only if an official button (e.g. “view PDF”) is provided.
Images meant for browser use only (e.g. zoom views) may not be downloaded locally.
Zwischengas support may grant exceptions in justified cases. Excessive use of downloads may result in termination of subscription, with refunds for unused time.
Reproduction, distribution, or publication of Zwischengas content (text, facsimiles, tables, data, media, etc.) is only permitted with express written consent. This includes the printed yearbook.
Unauthorized use of ads (e.g. feeding into other services) is prohibited.
11. Copyright Conflicts
Zwischengas makes efforts to identify rights holders and share proceeds fairly. If copyrights are violated, users can report this via [email protected]. Zwischengas will respond promptly and seek a solution.
12. User Content, Reviews, Ads, and Comments
By submitting content, users grant Zwischengas AG an unlimited, free license to reuse it. Ads may also be published elsewhere. Users are responsible for accuracy and legal compliance. Comments must relate to the topic and must not include defamatory, racist, pornographic, or extremist content. Only users with verified first and last names may comment. Violations may lead to comment removal and account termination. Legal responsibility rests with the user. Named individuals or companies must have given prior written permission to be mentioned. Zwischengas may delete or block content at its discretion.
Content not relevant to the general readership may be deleted without explanation, and accounts may be removed.
13. Contract Duration and Termination
Creating an account implies acceptance of these T&C. Continued use after account deletion is prohibited. Subscriptions are valid for the agreed period and may renew automatically, with clear notice during purchase.
14. Right of Withdrawal
You may cancel your contract within 14 days in writing (letter, fax, email). Send your cancellation to:

If cancelled properly, both parties must return benefits received. If full or partial return is not possible, compensation may apply. Refunds must be processed within 30 days. The deadline starts when the user sends the cancellation; for Zwischengas, when it is received.
A processing fee of EUR 10 / CHF 11.50 applies to credit card refunds. If the refund is less than the fee, no funds are exchanged. This applies to automatically renewed subscriptions as well. The right of withdrawal expires if the contract is fulfilled by both parties before withdrawal is exercised.
15. Applicable Law and Jurisdiction
Swiss law applies, excluding the UN Sales Convention. Jurisdiction is Sachseln (Obwalden), though Zwischengas may also sue in the user’s place of residence.
16. Final Provisions
If any provision is invalid, the remaining terms remain unaffected. Invalid provisions shall be replaced by legally valid terms that best reflect the original intent. Zwischengas reserves the right to amend these T&C at any time. Users must keep informed via the zwischengas.com website.
